Important Guidelines for Starting a Hotel/Restaurant in Compliance with Food Safety and Quality Laws

If you are planning to start a hotel or restaurant, it is essential to be aware of and comply with food safety and quality regulations. Here are the key points to keep in mind:

Basic Licensing Requirements:

1. Local Authority License:
   Before starting operations, you must obtain a license from the local governing body (Municipality/Panchayat).
2. Pollution Control Board Approval:
   Clearance from the State Pollution Control Board is also required, especially for establishments generating waste or emissions.
3. FSSAI License (Food Safety and Standards Authority of India):
   According to the Food Safety and Standards Act, 2006, it is mandatory to obtain an FSSAI license before commencing any food-related business.

     Operating without an FSSAI license can lead to a fine of up to ₹10 lakhs.

How to Apply for FSSAI License:

The application must be submitted online, and the following documents are required:

• Aadhaar Card
• PAN Card
• Water Testing Report
• Business Registration Documents (if it is a partnership or company)

After Obtaining the FSSAI License:

Once you receive your FSSAI license:

• It must be visibly displayed in the premises for customers to see.
• Medical Fitness Certificates (issued within the last 1 year) must be available for all food handlers.
• A recent water test report (within the last 6 months) must be maintained for both drinking and cooking water.
• Packaged (takeaway) food should have clear labeling with the preparation time and “best before” time.
• The kitchen and dining area must be clean, well-lit, and well-ventilated.
• All food items should be stored covered at all times.
• Waste bins must be covered to prevent contamination.

Hygiene and Storage Practices:

• Employees should be trained in food safety protocols.
• In refrigerators:
  • Vegetarian and non-vegetarian, raw and cooked, cleaned and marinated items should be stored separately with proper date coding.
• Prohibited substances or artificial colors not approved for use must never be added to food items.

Legal Compliance:

Restaurant/hotel owners must ensure that the establishment is run in strict compliance with the applicable food safety laws.
